These Terms shall not be construed to convey title to or ownership of the Website or the data contained therein to any User. All rights in and to the Website not expressly granted to User are reserved by welovelocal.com.
6.2 You and Your Business are granted a non-transferable, non-exclusive, royalty-free, revocable licence to view and print the content of the Website for Your Business' internal purposes and to publish information relating to Your Business on Your Business' website and marketing materials. You may also make use of such application process interface ("API") as welovelocal.com shall in its sole discretion make available to you or Your Business from time to time, subject to the restrictions in relation to the same displayed on the Website from time to time. For the avoidance of doubt, welovelocal.com shall be entitled to discontinue or amend your and Your Business' rights to use the API at anytime without notice to you.
6.3 You and Your Business are expressly prohibited from:
6.3.1 reproducing, copying, editing, transmitting, uploading or incorporating into any other materials, any of the Website; and
6.3.2 removing, modifying, altering or using any registered or unregistered marks/logos owned by welovelocal.com, and doing anything which may be seen to take unfair advantage of the reputation and goodwill of welovelocal.com or could be considered an infringement any of the intellectual property rights owned and/or licensed to welovelocal.com, without first obtaining the written permission of welovelocal.com.
7. Warranties and Liabilities
7.1 welovelocal.com provides registered business Users with access to the Website free of charge and, to the maximum extent permitted by law, welovelocal.com shall not be liable for any loss, injury or damage of whatever kind caused in whole or in part by Use of the Website or the information provided therein, or by any failure, delay, interruption or otherwise of the provision of the Website or the information provided therein, or by welovelocal.com's failure to perform any of its obligations under these Terms.
7.2 In no event shall welovelocal.com be liable for any special, indirect, incidental or consequential damages, including loss of profits and goodwill, business or business benefit.
7.3 The information provided on the Website by welovelocal.com is intended as information only and does not constitute advice. Therefore, it must not be relied on to assist in making or refraining from making a decision, or to assist in deciding on a course of action.
7.4 Where the Website or any Submission made by any User includes views, opinions, advice and recommendations, these views, opinions, advice and recommendations are not endorsed by welovelocal.com and, to the maximum extent permitted by law, welovelocal.com shall not be liable on account of the accuracy, defamatory nature, completeness, timeliness or otherwise of such views, opinions, advice and recommendations.

8.1 welovelocal.com is committed to protecting (i) the privacy of individual Users; and (ii) the confidentiality of the information provided to it by Users using the Website, other than in relation to Submissions which for the avoidance of doubt may be displayed on the Website in accordance with these Terms and as such may be viewed by visitors to the Website. welovelocal.com is not able to control the use by third parties of any information appearing on the Website.
8.2 welovelocal.com reserves the right to gather information relating to use of the Website. By using the Website you consent to collection and use of this information and other information by welovelocal.com in accordance with our Data Protection and Privacy Policy.
9. General
9.1 You may print and keep a copy of these Terms, which form the entire agreement between you, Your Business and welovelocal.com and supersede any other communications or advertising with respect to the Website.
9.2 These Terms may only be modified with the prior written consent of welovelocal.com. welovelocal.com may alter or amend these Terms at any time, with immediate effect without notice. By continuing to Use the Website after such alteration, you and Your Business will be deemed to have accepted any amendment to these Terms.
9.3 These Terms and their performance shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the courts of England.
9.4 You and Your Business shall comply with all foreign and local laws and regulations which apply to your Use of the Website in whatever country you are physically located, including without limitation, consumer law, export control laws and regulations.
9.5 You and Your Business agree that because of the unique nature of the Website and welovelocal.com's proprietary rights therein, a demonstrated breach of these Terms by you and Your Business would irreparably harm welovelocal.com and monetary damages would be inadequate compensation. Therefore, you and Your Business agree that welovelocal.com shall be entitled to preliminary and permanent injunctive relief, as determined by any court of competent jurisdiction to enforce the provisions of these Terms.
9.6 If any provision of these Terms is declared void, illegal, or unenforceable, the remainder of these Terms will be valid and enforceable to the extent permitted by applicable law. In such event, the parties agree to use their best efforts to replace the invalid or unenforceable provision by a provision that, to the extent permitted by the applicable law, achieves the purposes intended under the invalid or unenforceable provision.
9.7 Any failure by any party to these Terms to enforce at any time any term or condition under these Terms will not be considered a waiver of that party's right thereafter to enforce each and every term and condition of these Terms.
9.8 No party will be responsible for delays resulting from circumstances beyond the reasonable control of such party, provided that the nonperforming party uses reasonable efforts to avoid or remove such causes of non-performance and continues performance hereunder with reasonable dispatch whenever such causes are removed.
9.9 Nothing in these Terms shall give, directly or indirectly, any third party any enforceable benefit or any right of action against welovelocal.com and such third parties shall not be entitled to enforce any term of these Terms against welovelocal.com.

Terms and Conditions of the 'Do you love local?' Competition ("the Competition"), operated by GCap Interactive, GCap Media Plc, 30 Leicester Square, London, WC2H 7LA ("the Operator").
In order to participate in this Competition, Entrants must accept must accept these Terms and Conditions in their entirety and the decision of Operator on all matters concerning this Competition will be final.
Details of Competition
- The objective of Competition is to generate as many reviews of local businesses and venues within www.welovelocal.com by end of the Competition
- This Competition is an internal GCap competition not a listener/user competition
- Prize of £5,000 cash for the winning Group
- Groups should be set up by station, department or team to enable all GCap employees to participate ('Groups')
- The Competition shall run from 7th April 2008 until 5pm on 30th May 2008 (the Duration)
- Winning Group is the Group with the most number of reviews per Entrant
- To enter the Competition, entrants (each an "Entrant") must complete the following initial steps -
1. Go to www.welovelocal.com
2. Register as a site member (all entrants should read and agree to comply to site T&Cs) - ideally each Entrant should upload a profile image of themselves. Each entrant must not register under more than one profile name.
3. Join the relevant 'Group' if it already exists for your station, department or team. Or create a new group if it hasn't already been set up. Each Entrant can only join 1 group.
Competition Mechanic
- Once registered and assigned to a Group each Entrant can start writing reviews on www.welovelocal.com
- Each Entrant can now start to write as reviews and should attempt to submit as many reviews as possible. Entrants can write reviews of businesses in their area but can also review businesses in other areas that they have knowledge of. Reviews can be positive or negative, but at all times must be genuine.
- Reviews by all members of a Group will be attributed to that Group for the sake of the Competition - it's a team effort
- There is no restriction on the number of reviews that can be written by each Entrant. However each review must be over 25 words in length to qualify for inclusion in the Group's total
- At the end of the Duration all reviews will be counted up and an average reviews per group members, including friends and family of GCap employees, will be calculated e.g. 10 members in group - 180 reviews = 18 reviews/member
- The Group with the highest average reviews per member will be deemed the winner. In the event of a tie the Group with the highest total word count will be deemed to be the outright winner
- The winning Group will receive £5,000 in cash to be split/used at the Group's discretion
In the event of a malfunction of either software or hardware required by the Operator to run this Competition, the Operator reserves the right to suspend prize distribution and/or the Competition without notice.
Eligibility
- Entrants must be GCap employees or friends or family of GCap employees to contribute to their Group's total (although they will not be eligible to receive a share of the winnings). Friends and family must register separate profiles and join the relevant Group to maximise new users - rather than writing reviews using the login details of the GCap employee.
- Any stations found to have enlisted the help of station listeners, website users through station promotion will be penalised at discretion of Operator
- Entrants must be aged 18 or over to enter the Competition. The Operator reserves the right to request age and identification documents and at its discretion may use an independent age and identification verification service.
- Any Entrant found to be under the age of 18 years will be disqualified immediately and where any prizes won shall be forfeited.
- The Operator reserves the right, at its sole discretion and without cause, to disqualify any individual from entering the Competition. A breach of these terms and conditions, or a breach of the terms of conditions of www.welovelocal.com will constitute grounds for disqualification.
- These Terms & Conditions may be amended by the Operator at any time within the Duration.
- Only individuals may contribute reviews to each registered member/Entrant's account on www.welovelocal.com
- Eligible reviews for the competition will only be counted as part of a station or section's total if they are added to the station or section's group
- Any evidence of duplicated or generically reproduced reviews will result in the group member who submitted the reviews in question being disqualified
Prizes
- £5,000 cash will be awarded to the winning Group at end of the duration
- Only GCap Employees are eligible to receive a share of the winnings to be split/used at the Group's discretion
- Winning Group will be contacted by the Operator within 5 working days from the end of the Duration
- Winners should allow up to 4 (four) weeks for delivery of their prize
- No substitution or transfer of prizes is permitted
- The Operator reserves the right to verify the eligibility and identity of any winner before prizes are distributed, and further reserves the right to refuse a prize distribution to any Entrant who breaches any of these Terms and Conditions
- Entrants who are members of the winning Group consent to the use of their names, Group details, and general geographical locations, for internal promotional purposes
